TERMS OF BUSINESS
- The verbal or written instruction to Butterfly Personnel (the Agency) by the Client, to submit suitable applicants is deemed to be an acceptance of our terms, conditions and fee. These terms and conditions shall represent a legally binding contract between Butterfly Personnel and the client and are non negotiable.
- All introductions of applicants by the agency and their details shall remain confidential and must not be passed indirectly to other potential Employers or Employees. A sum equivalent to the full introduction fee will be charged to the employer if this undertaking is breeched.
- Clients must reimburse to the applicants travelling expenses incurred when attending the interview providing receipts are given.
- Whilst the agency endeavours to interview personally potential employees and obtain references, it is the employers' responsibility to satisfy themselves as to the suitability of the employee for the engagement. The agency does not accept any responsibility or liability for any loss, damage, expense delay or personality clashes resulting from the agency's introduction nor do they give any guarantee concerning the suitability of any applicant introduced by the agency. It is up to the client to satisfy themselves in this respect
- Should the Client contact, or be contacted by a prospective employee by the suggestion of the agency and at that stage decline to offer an interview or employment but at some time within 240 days decide to employee that person, whether it be the result of a personal advertisement, or for whatever reason in a childcare capacity it will be deemed that such employment is a direct result of an introduction from the Agency the full fee will be due.
- The Client shall take all reasonable precautions to ensure the health and safety of any employee while on the Clients premises.
FEES
- The agency must be paid the full agency fee at least two weeks prior to the booking commencing. If the booking exceeds the arranged dates it must be paid as soon as extra dates have been agreed.
- The Agency must be paid prior to the Client leaving the UK.
- The Agency reserves the right to review the fees at any time however one month's notice will be given of any change.
- In the event that you the client cancel your booking once an applicant has been hired, the client will still be due an administration fee to the agency
- More that 4 weeks notice £80
- less than 4 weeks notice £50% of remaining fee
- Agency fees are non-refundable once the booking has commenced, however If during the booking unforeseen circumstances arise resulting in the departure of the applicant a replacement will be offered if available providing:
- The Agency fee has been received by the due date.
- The Agency is advised in writing as to the nature of the termination within 24 hours.
- There has been no reasonable cause for the applicant to terminate employment.
- The departure is due to an unprofessional conduct of the applicant
- Please note that we take a £30 to £80 deposit to secure all bookings that must be paid as soon as the applicant is booked, emergency booking must pay this deposit immediately. This should be paid over the telephone ( this will be deducted from fees but is non refundable if you cancel except under special circumstances)
- All agency fees will be quashed in special circumstances.
- Please not that these are the agencies terms and conditions, the agency act on behalf of our applicants who have will have their own terms / contract. We the agency insist that our applicants are paid each week and not owed any monies when the booking ends.
